British lawyer Karim Khan was sworn in Wednesday as the new chief prosecutor for the International Criminal Court, pledging to reach out to nations that are not members of the court in his quest to end impunity for atrocities and to try to hold trials in countries where crimes are committed.
Khan, a 51-year-old English lawyer, has years of experience in international courts as a prosecutor, investigator and defense attorney. He takes over from Fatou Bensouda of Gambia, whose nine-year term ended Tuesday.
“The priority for me, and I believe that’s the principle of the Rome Statute, is not to focus so much on where trials take place, but to ensure that the quest for accountability and inroads on impunity are made,” Khan said, referring to the treaty that founded the court, in his first speech after taking his oath of office.
“The Hague itself should be a city of last resort,” he said. “Wherever possible, we should be trying to have trials in the country or in the region.”
Khan said he wanted to work with countries that are not among the court’s 123 member states to achieve justice. World powers the United States, Russia and China are not members and do not recognize the court’s jurisdiction.
“My conviction is that we can find common ground in the quest and in the imperative to ensure we eradicate genocide, crimes against humanity and war crimes,” Khan said.
Most recently, Khan led a United Nations team investigating atrocities in Iraq, telling the Security Council last month that he uncovered “clear and compelling evidence” that Islamic State extremists committed genocide against the Yazidi minority in 2014.
In the past, he has defended clients at international courts including former Liberian President Charles Taylor and Kenya’s Deputy President William Ruto. ICC prosecutors dropped charges against Ruto and President Uhuru Kenyatta of involvement in deadly post-election violence in their country.

Judge: Pretrial release OK for man accused in Capitol riot

A judge has ruled that one of two Oregon brothers accused in the insurrection at the U.S. Capitol will be released from custody Friday to a third-party guardian, where he will be on home detention and GPS monitoring pending his trial.
U.S. District Judge Randolph D. Moss, of the District of Columbia, on Thursday granted Matthew Klein’s pretrial release to a Baker County couple after refusing to allow him to stay with his parents. Moss last week cited text messages that showed Klein’s mother and father warning Matthew’s younger brother and co-defendant Jonathanpeter Klein not to broadcast their roles, noting “braggers get caught,” according to court testimony and documents, The Oregonian/OregonLive reported.
Matthew Klein, 24, and Jonathanpeter Klein, 21, both have pleaded not guilty to conspiracy to defraud the United States, aiding and abetting in the obstruction of an official proceeding, obstruction of law enforcement during civil disorder, destruction of government property, entering and remaining in a restricted building or grounds, and disorderly conduct in a restricted building or grounds.
The judge ordered Matthew Klein to be released to a woman who is retired from Baker County government and lives with her husband, a prison guard at the Powder River Corrections Facility, court documents said. He’ll be released on Friday once he is fitted with a location monitoring device.
Jonathanpeter Klein also has asked for pretrial release to a third-party guardian, under home detention and GPS monitoring. Federal prosecutors don’t object. His release hearing will be held in early June.

NYC corruption case prompts dismissal of 90 drug convictions

Prosecutors are asking a New York City court to throw out 90 drug convictions following a review of arrests involving a former narcotics detective charged with corruption.
The mostly low-level cases investigated by Joseph Franco while a NYPD officer in Brooklyn from 2004 to 2011 should be vacated because of his ongoing criminal case in Manhattan, Brooklyn District Attorney Eric Gonzalez said Wednesday. A 2019 indictment accuses Franco of perjury and other charges alleging he framed innocent people.
The review of the mostly low-level Brooklyn cases dating back a decade or more found no similar misconduct on Franco’s part or that the defendants were innocent, prosecutors said Wednesday. But because of the Manhattan case, “I have lost confidence in his work,” Gonzalez said in a statement.
“I cannot in good faith stand by convictions that principally relied on his testimony,” he added.
Tina Luongo, attorney-in-charge of the Legal Aid Society’s criminal defense practice, lauded Gonzalez’s decision to vacate the convictions. She urged other district attorneys in the city to perform similar reviews.
Franco “touched thousands of cases throughout New York City, and we may never know the full extent of the damage he caused and lives he upended,” Luongo said in a statement.
During a virtual hearing on Wednesday morning, a judge began the process of vacating the cases at the request of defense attorneys. At issue were 27 felony and 63 misdemeanor convictions, most resulting from guilty pleas.

Judge tosses New Mexico rancher’s claim after he kills wolf

A federal judge has tossed a rancher’s claim that he should still have the right to use federal land in New Mexico after it was revoked for killing a wolf.
Craig Thiessen killed an endangered Mexican wolf in Gila National Forest six years ago and has since argued that he should still be allowed to graze his cattle on the 48,000 acres (about 194 square kilometers) of public land, the Santa Fe New Mexican reported on Friday.
That argument was rejected this week by U.S. Magistrate Judge Gregory Fouratt.
Thiessen pleaded guilty in 2018 for killing the wolf. He faced a year of probation and a $2,300 fine. Later that year, the U.S. Fish and Wildlife Service revoked his company’s permit to graze cattle on the public land.
A court document said he had 286 cows and 143 calves on the property. Thiessen has continued legal action in an attempt to keep his cattle on the land. The federal fish and wildlife service has sued Thiessen to remove the cows.
Hayden Ballard, an attorney who has represented Thiessen, did not respond to a request for comment on Friday by the newspaper.
Representatives from four conservation groups said in a statement that Thiessen had given up his privileges to use the public land after his actions.
Greta Anderson from the Western Watersheds Project accused Thiessen on Friday of animal cruelty by killing the wolf. The Santa Fe New Mexican reported that numerous accounts said the young wolf’s leg was caught in a trap and it was then struck with a shovel.

Dinamo Zagreb coach quits after receiving prison sentence

Zoran Mamic quit as Dinamo Zagreb coach after Croatia’s Supreme Court confirmed his nearly five-year prison sentence for tax evasion and fraud, just days before the Croatian champions play a Europa League match against Tottenham.
“Although I do not feel guilty, as I announced earlier, if the verdict is final, I accept it as such and resign from the position of head coach and sports director of GNK Dinamo,” Mamic said in a statement late Monday. “I wish the club a lot of luck and sporting success in its future work.”
Mamic has no further avenue for appeal, and will have to go to prison upon receiving the formal notification of the court ruling.
Mamic and his brother Zdravko, a former Dinamo Zagreb executive director, were charged with embezzling the equivalent of $18 million from the sale of Dinamo Zagreb players to foreign clubs, and for tax evasion worth $2 million.
The Mamic brothers were suspected of embezzlement through fictitious deals made during transfers of several former Dinamo players to foreign clubs, including Luka Modric to Tottenham in 2008.
The Real Madrid midfielder, a former FIFA player of the year, was a key witness during the trial, testifying about his financial deals with the Mamics.
Zoran Mamic was sentenced to four years and eight months in prison. Zdravko Mamic, who was sentenced to six years and six months, fled to Bosnia shortly after a lower court passed the original sentences in 2018.
The Supreme Court also confirmed a three-year prison sentence for former Dinamo director Damir Vrbanovic.
The club said Mamic would be replaced as coach by Damir Krznar.
Dinamo is scheduled to host Tottenham on Thursday in the return leg of their Europa League playoff. Tottenham won the first leg 2-0 last week.
